Terms and Conditions

The terms & conditions set out below govern the use of the services offered by PT. Djaya Dipa Indonesia regarding the use of the website www.hobikoe.com and the Hobikoe mobile application. Users are advised to read carefully because it can affect the rights and obligations of the User under the law.

By registering and/or using the www.hobikoe.com site and the Hobikoe mobile application, the user is deemed to have read, understood, understood and agreed to all contents in the Terms & conditions. These terms & conditions are a form of agreement as outlined in a valid agreement between the User and PT. Djaya Dipa Indonesia. If the user does not agree to one, part, or all of the contents of the Terms & Conditions, then the user is not allowed to use the services at Hobikoe.

I. Definition

1. PT Djaya Dipa Indonesia is a limited liability company that operates a web portal service business activity www.hobikoe.com, which is a search site for shops and goods sold by registered sellers. Hereinafter called Hobikoe.

2. Hobikoe's website is www.hobikoe.com.

3. Terms & conditions is an agreement between the User and Hobikoe which contains a set of rules governing the rights, obligations, responsibilities of users and Hobikoe, as well as procedures for using the Hobikoe service system.

4. Users are parties who use Hobikoe services, but are not limited to buyers, sellers, including other parties who just visit the Hobikoe Site.

5. Buyer is a registered User who makes a request for Goods sold by the Seller on the Hobikoe Site.

6. Seller is a registered User who opens a store and or makes an offer of an item to Hobikoe Site Users.

7. Goods are objects that are tangible / have physical goods that can be delivered / meet the delivery criteria by the goods delivery service company.

8. Purchase Balance is a storage facility for buyer's funds provided by Hobikoe for PPOB purchases.

9. Assistance Ticket is a facility provided by Hobikoe to withdraw money for refunds, refund of goods transactions, purchase of digital products, purchases of damaged goods that will be transferred back to the buyer's account.

10. Sales Balance is a temporary storage facility for Seller's funds (not a fund storage facility), provided by Hobikoe to accommodate funds from the sale of Goods, investment products, and/or affiliate commissions on the Hobikoe Site. These funds can only be withdrawn to the registered bank account and cannot be used again to make purchases on the Hobikoe Site.

11. Banner Image is a feature on the Hobikoe Site/Application that displays information, product promotions for sale and content from Sellers, including today's attractive promo banners, bestsellers for you, official store banners, category banners

12. Official Store: Official store is a seller service in Hobikoe which is intended for selected sellers to develop their business exclusively. And Buyers choose to shop at the Official Store compared to ordinary merchants because the quality of the goods is guaranteed. With 3 special guarantees for Official Store Buyers

13. Hobikoe payment system: is a system that was built to transact between sellers and buyers by means of manual transfer to the account of PT. Registered Djaya Dipa Indonesia

14. Hobikoe Official Account is a joint account agreed by Hobikoe and users to process buying and selling transactions on the Hobikoe Site. That is :

15. Delivery service is a service process in purchasing transactions in Hobikoe from seller to buyer with a delivery service system.

16. Delivery Service Feature is a delivery service in collaboration between PT Djaya Dipa Indonesia and PT. Sicepat Express Indonesia with the integration of the API program so that it can fulfill the various service features available, namely: Siuntung, Best, Gokil. Which will serve delivery services in the territory of the Republic of Indonesia.

17. Terms and conditions of delivery service are a form of Cooperation that is mutually agreed between the regulation of the Sicepat and Hobbykoe services available at https://www.sicepat.com/termCond

18. User Home is a menu that provides information about profile account data, products in the basket, Wishlist and products ordered

19. Seller's Home is a menu that provides information regarding profile account data, store account data, product data, total sales, total income, total sold and payments.

20. Profile Account Data is personal data either user or seller

21. Purchase History of Goods is the history of all purchases made on the Hobikoe Marketplace

22. PPOB Purchase History is the history of all purchases of digital product transactions on the Hobikoe Marketplace

23. Favorite is the product storage menu that is selected and liked

24. Conversation is a chat menu provided by Hobikoe to facilitate conversation between sellers and buyers

25. My wallet is the information system for the nominal balance that has been successfully transacted

26. Earning points is a form of promo from transaction value with terms and conditions that apply at Hobikoe

27. Ticket Assistance is a customer service service for services either users or buyers.

28. Manage Profile is account data containing basic information about name, phone number, password, address, and email address settings

29. Exit is the exit menu from the Application

30. Storefront is a menu of a collection of various product categories provided by hobbykoe

31. Order is a menu to view purchase orders for products being sold

32. Product Reviews is a menu of assessments from buyers of products and sellers

33. Store Settings is store data which contains basic info then logo, store banner, and store social media links

34. Withdrawal of Money is a menu for withdrawing money from store sales

35. Payment History is the payment history for the balance in Dompetku

36. Category is a product menu specially provided by Hobikoe which includes:

• Antiques, Toys, Books and Comics, Vintage Items, Classic Automotive, Watches and Jewellery, Diamonds and Gems, Numismatics, Artwork, Classical Fashion, Philately, Military, Batik, Antique Bikes, Musical Instruments, Documents, Keris and Tosan Aji, Fishing Equipment, Cars, Other Automotive, Flora and Fauna, Sports, Bicycles, Arts and Crafts, Lifestyle, Motorcycles

37. The Bell Icon is a notification notification icon

38. The Heart icon is the selected favorite product icon


II. Account, Refund, Income Balance, Password and Security

1. The user hereby declares that the user is a competent person and is able to bind himself in a legal agreement according to law.

2. Hobikoe does not charge a registration fee to Users.

3. User understands that 1 (one) phone number can only be used to register 1 (one) Hobikoe User account, except for Users who already have multiple accounts with 1 (one) previous phone number

4. Users who have registered have the right to act as:

a. Buyer

b. Seller

c. Open Shop

5. Users who will act as Sellers are required to choose the option of using the Be a Seller service. After using the Be a Seller service, the User has the right to make arrangements for the items to be traded in the User's personal storefront.

6. Hobikoe without prior notification to the User, has the authority to take necessary actions for any alleged violation or violation of the Terms & conditions and/or applicable law, namely actions in the form of moving the Goods to the warehouse, deletion of Goods, store moderation, store closure, cancellation of listing, suspension of accounts, and/or deletion of user accounts.

7. Hobikoe has the authority to close the store or User's account either temporarily or permanently if fraudulent transactions are found, violations of the Hobikoe Terms and Conditions, including but not limited to the User Penalty Policy. The user agrees that Hobikoe has the right to take other necessary actions regarding this matter, including but not limited to refusing the application for a new store opening if data similarities are found.

8. The user understands and agrees not to use, modify, disassemble, duplicate, resell and/or other exploiting activities on the software system or hardware, network and/or Site/Application data with automatic or manual technology without permission. from Hobikoe.

9. The user agrees not to use and/or access the Hobikoe system directly or indirectly either in whole or in part with viruses, software, or other technologies that may result in weakening, damaging, disrupting or inhibiting, limiting and/or taking over functionality and integrity of the software or hardware systems, networks, and/or data on the Hobikoe Platform.

10. Users are prohibited from creating and/or using software tools, features, and/or other tools aimed at accessing or using services on the Hobikoe system, such as but not limited to: (a) store data manipulation; (b) create multiple accounts; (c) manipulating devices aimed at harming Hobikoe; (d) crawling/scraping or content copying activities; (e) automation activities in transactions, buying and selling, promotions, and so on; (f) addition of products to the storefront; (g) collect (harvest) or steal user data; (h) spamming, sending electronic communications in bulk, sending chain letters; and/or (i) other activities that can reasonably be assessed as acts of manipulating services and systems.

11. Hobikoe has the authority to adjust the number of store transactions, adjust the number of reputations, and/or carry out the moderation process/close the User's account, if it is known or suspected that there is fraud by the User aimed at manipulating User transaction data in order to improve the store's reputation (review and or amount transaction). An example is doing the shopping process to the store itself using a personal account or other personal accounts.

12. Refunds come from refunds for purchases of goods, digital products on the Hobikoe Platform and cannot be added independently (top up).

13. Refunds can be used as a payment method for purchases of goods, digital products on the Hobikoe Platform, and withdrawals can be made to the bank account registered in the User's account.

14. Income balance only comes from the sale of goods, products and or affiliate commissions on the Hobikoe Platform and cannot be added independently (top up).

15. Income balance can only be withdrawn to a bank account registered in the User's account, and cannot be used as a payment method for purchasing transactions for Antiques and Hobbies, digital products, on the Hobikoe Platform, but can be used for features subscriptions that help Sellers, such as TopAds or store discount promos.

16. Hobikoe has the authority to freeze Refund Balance and User Income Balance if it is found/suspected of fraud in transactions and/or violation of Hobikoe's terms and conditions.

17. Sellers are prohibited from duplicating stores, duplicating products, or other actions that may be indicated as unfair competition efforts.

18. The user has the right to change the store name and/or store domain in accordance with the policies determined by Hobikoe. The User must ensure that changes to the store name and/or store domain are as desired and the User is personally responsible for changes to the store name and/or store domain made by the User. The User agrees that any engagements and legal actions that occurred prior to the change of the store name and/or store domain remain binding on the User.

19. The user has the right to make changes to the account name as much as the number of opportunities provided and Hobikoe has the right to change the number of opportunities to change the account name. The User must ensure that the changes to the account name are in accordance with the wishes and are personally responsible for changes to the account name made by the User. The User agrees that any engagements that occurred prior to the name change remain binding on the User.

20. The User is personally responsible for maintaining the confidentiality of the account and password for all activities that occur in the User's account.

21. Hobikoe will not ask for a username, password or verification SMS code or OTP code belonging to the User's account for any reason, therefore Hobikoe urges Users not to provide such data or other important data to parties on behalf of Hobikoe or other parties that cannot be guaranteed its safety.

22. The User agrees to ensure that the User logs out of the account at the end of each session and notifies Hobikoe of any unauthorized use of the User's password or account.

23. User hereby declares that Hobikoe is not responsible for any losses or problems arising from misuse of User accounts caused by User negligence, including but not limited to agreeing and/or providing account login access sent by Hobikoe via notification messages to other parties. through a User's device, lending an account to another party, accessing a link or links provided by another party, providing or showing a verification code (OTP), password or email to other parties, or the negligence of other Users which results in losses or problems in the User's account.

24. The User understands and agrees that to use the one time password (OTP) security facility, the relevant telecommunications service provider may at any time charge the User with the following nominal (a) Rp 500 plus 10% tax for Indosat, Tri, XL, Smartfren, and Esia; (b) IDR 200 plus 10% tax for Telkomsel.

25. Sellers are prohibited from promoting shops and/or goods directly using private message facilities, product discussions, product reviews which may disturb the convenience of other users.

III. Purchase

1. Buyers are required to transact through transaction procedures that have been determined by Hobikoe. The Buyer makes a payment using the payment method previously chosen by the Buyer, and then Hobikoe will forward the funds to the Seller if the stages of the sale and purchase transaction on the Hobikoe system have been completed.

2. When making a purchase of Goods, the Buyer agrees that:

a. The buyer is responsible for reading, understanding, and agreeing to the information/description of the entire Goods (including but not limited to color, quality, function, etc.) before making an offer or commitment to purchase.

b. The Buyer acknowledges that the actual color of the product as seen on the Hobikoe Site/Application depends on the Buyer's computer monitor and mobile phone screen. Hobikoe has made its best efforts to ensure that the colors in photographs displayed on the Hobikoe Site/App appear as accurate as possible, but cannot guarantee that the color appearance on the Hobikoe Site and app will be accurate.

c. The User enters into a legally binding contract to purchase the Goods when the User purchases an Item.

d. Hobikoe does not transfer legal ownership of the goods from the Seller to the Buyer.

3. The Buyer understands and agrees that the availability of stock of the Goods is the responsibility of the Seller who offers the Goods. Regarding the availability of stock of goods, it can change at any time, so that when the stock of goods is empty, the seller will refuse the order, and payment for the goods in question will be returned to the buyer.

4. The Buyer fully understands and agrees that all transactions made between the Buyer and the Seller other than through the Hobikoe Official Account and/or without Hobikoe's knowledge (through private facilities/networks, messaging, special transaction arrangements outside the Hobikoe site or other efforts) are the responsibility of Buyer's personal responsibility.

5. Hobikoe has full authority to refuse payment without prior notification.

6. The Buyer agrees and understands that by using the Hobikoe Site/Application when the Buyer makes a purchase transaction, Hobikoe will forward the Buyer's information data to the Seller.

7. Buyers who use the bank transfer payment method, the total value of the payment will be added with a unique code to simplify the verification process. If the payment has been verified,

8. Buyers are required to make payments using the selected payment method with a nominal amount that corresponds to the billed amount along with the unique code (if any) listed on the payment page. PT Hobikoe is not responsible for the losses suffered by the Buyer, if the Buyer makes a payment that does not match the amount of the bill stated on the payment page.

9. Payment by the Buyer must be made immediately (at the latest within 2x24 hours) after the Buyer checks-out. If within that time limit the payment has not been made by the Buyer, Hobikoe has the authority to cancel the transaction. Users are not entitled to submit claims or demands for the cancellation of the transaction.

10. Buyers are advised to re-check the nominal amount of payment with the billing amount listed on the payment page. Especially for payments via bank transfer (manual verification), if there is a lack of payment on the amount of the bill that should be paid, the Buyer will receive a notification via e-mail of the Buyer registered on the Site/Application, in order to make a payment back to the official Hobikoe account, according to the difference in payment stated on the payment page and the nominal amount that has been paid, up to a predetermined time limit.

11. Payment by bank transfer payment method (manual verification) is highly recommended to upload proof of payment on the Hobikoe Platform to simplify the verification process.

12. The Buyer understands and agrees that the problem of delays in the payment process and additional costs caused by the difference between the bank the Buyer uses and the official Hobikoe Account bank is the Buyer's personal responsibility.

13. Refunds from Hobikoe to Buyers can only be made in the following certain circumstances:

a. Excess payment from the Buyer over the price of the Goods,

b. The problem of delivery of goods has been clearly identified from the seller which resulted in the goods order not arriving,

c. The seller cannot accept orders due to out of stock, changes in shipping costs, or other causes,

d. The seller has agreed to deliver the goods order, but after the specified time limit, it turns out that the seller does not send the goods until the specified time limit.

e. Resolution of problems through a help ticket in the form of a decision to refund to the Buyer or the result of a decision from Hobikoe.

14. In the event of a refund process, the refund will be made through the User's Refund Balance which will increase according to the refund amount.

15. Buyers are prohibited from dividing 1 (one) transaction of purchasing Goods into 2 (two) transactions or more separately to divide the payment value (split payment) with the aim of manipulating the payment method and/or obtaining extra benefits that violate the Terms and Conditions, which is carried out in any way including but not limited to contacting the Seller to make price changes and/or purchase multiple products to divide the total price of a desired product.

16. The buyer understands and agrees to release Hobikoe from responsibility if there are problems with transactions using the split payment method, including but not limited to transaction problems, payment problems, delivery problems, as well as damage and/or loss of Goods either partially or completely.

17. Hobikoe is authorized to take necessary actions if it is known that there is a purchase transaction using the split payment method, including but not limited to transaction cancellation and/or promo or discount cancellation.

18. The buyer agrees not to notify or submit proof of payment and/or payment data to parties other than Hobikoe. In the event of a loss due to notification or submission of proof of payment and/or payment data by the Buyer to another party, then this will be the responsibility of the Buyer.

19. The buyer is obliged to confirm receipt of the Goods, after receiving the shipment of the purchased Goods. Hobikoe provides a time limit of 2 (two) days after the delivery is "sent" in the Hobikoe system, for the Buyer to confirm receipt of the Goods. If within that time limit there is no confirmation or claim from the Buyer, then the Buyer thus agrees to confirm the receipt of the Goods automatically by the Hobikoe system.

20. After confirmation of receipt of Goods or confirmation of automatic receipt of Goods, the Buyer's funds sent to the official Hobikoe Account will continue to be sent to the Seller (the transaction is considered complete).

21. The buyer understands and agrees that any claims made after confirmation / automatic confirmation of receipt of the Goods are not the responsibility of Hobikoe. Losses that arise after confirmation/automatic confirmation of receipt of the Goods are the responsibility of the Buyer personally.

22. The Buyer understands and agrees that any problems with the delivery of Goods caused by late payment are the responsibility of the Buyer.

23. Hobikoe has the authority to make decisions on unresolved transaction problems due to the absence of a settlement agreement, both between the Seller and the Buyer, by looking at the available evidence. Hobikoe's decision is a final decision that cannot be contested and binds the Seller and the Buyer to comply.

IV. Sales Transaction

1. The seller is prohibited from manipulating the price of the Goods for any purpose.

2. The seller is prohibited from offering/trading prohibited goods in accordance with what has been stipulated in the provisions of the type of goods.

3. The seller is obliged to provide complete and clear photos and product information in accordance with the conditions and quality of the products he sells. If there is a discrepancy between the photo and product information uploaded by the Seller and the product received by the Buyer, Hobikoe has the right to cancel/withhold transaction funds.

4. In using the "Product Name", "Product Photo", and "Product Description" Facility, the Seller is prohibited from making rules in the form of standard clauses that do not comply with the prevailing laws and regulations in Indonesia, including but not limited to (a) not accepting complaints, (b) not accepting returns (exchange of goods), (c) not receiving refunds (refunds), (d) goods without warranty, (e) transfer of responsibility (including but not limited to covering shipping costs), (f) depreciation of the price value and (g) the unilateral delivery of random goods. If there is a conflict between store records and/or product descriptions with the Hobikoe Terms & Conditions, the applicable rules are the Hobikoe Terms & Conditions.

5. The seller is obliged to provide a reply to accept or reject the Buyer's goods order within 2 days from the notification of the Goods order from Hobikoe. If within that time limit there is no reply from the seller, the order will automatically be cancelled.

6. In order to maintain the convenience of the Buyer in transactions, the Seller understands and agrees that Hobikoe has the right to moderate the Seller's shop if the Seller rejects, cancels and/or does not respond to the Buyer's Goods order with suspicion of manipulating the transaction, violating the Terms and Conditions, and/or fraud or other abuse.

7. The seller is prohibited from providing a separate payment method (split payment) and/or dividing 1 (one) Goods purchase transaction into 2 (two) different transactions with the aim of manipulating the payment method and/or obtaining additional benefits that violate the Terms and Conditions, which is done in any way including but not limited to using a "product variant" service or selling multiple products thereby dividing the total price or transaction of a desired product.

8. The seller understands and agrees to release Hobikoe from responsibility if there are problems with transactions using the split payment method, including but not limited to transaction problems, payment problems, delivery problems, as well as product damage and/or loss, either partially or completely.

9. Hobikoe is authorized to take necessary actions if it is known that there is a sale transaction using the split payment method, including but not limited to transaction cancellation, store reputation adjustment, product deletion, store moderation, and/or store closure.

10. The Seller agrees and understands that by receiving the Buyer's information data contained in the Hobikoe Platform, he is obliged to maintain confidentiality and is prohibited from abusing the Buyer's information data in any form. Hobikoe reserves the right, without prior notice, to investigate and impose sanctions on suspected or reported misuse of Buyer data.

11. Sellers are expected to enter a valid delivery receipt number or AWB (air way bill), namely:

a. The date of making the Goods delivery receipt is not earlier than the date of the Goods purchase transaction;

b. Goods delivery receipt number must be traceable or found on the tracking website or Hobikoe partner courier service system; and/or

c. Is a receipt for delivery of goods that are intended for buyers who will receive the package (delivery details must be the same).

d. If the delivery service is non-pickup, the seller must fill in the delivery receipt number

e. If the delivery service is pickup, the delivery receipt number will be issued automatically

12. The seller is required to enter a valid Goods delivery receipt number within 2 x 24 hours (excluding Saturday/Sunday/National holidays) as of the notification of the Goods order from Hobikoe.

13. If the Seller enters an invalid or untraceable Goods delivery receipt number, the Seller must enter a valid Goods delivery receipt number within 1 x 24 hours (excluding Saturday/Sunday/National holidays) as of the notification of the invalid receipt number or untracked provided by Hobikoe to the Seller.

14. If within the time limit in the Terms & Conditions of Point IV. 11 and IV. 12 The Seller does not enter a valid Goods delivery receipt number, then the order will automatically be considered cancelled. If the Seller continues to send the Goods after exceeding the delivery time limit as described above, then the Seller understands that the transaction will still be canceled for later the Seller can make a withdrawal of the Goods at the courier where the Goods were sent.

15. The Seller understands and agrees that the delivery courier cannot be changed by the Seller after the Seller confirms the delivery and is entirely the responsibility of the Seller.

16. Hobikoe is authorized to cancel transactions and/or withhold transaction funds in the event that: (a) the courier receipt number for the delivery of Goods provided by the Seller does not match and/or is suspected to be inconsistent with the transactions that occur on the Hobikoe Platform; (b) the Seller sends the Goods via courier/logistics services other than those provided and connected to the Hobikoe Site; (c) if the product name and product description do not match/unclear with the product being shipped; (d) if transaction manipulation is found; and/or (e) include the delivery receipt number of the Goods that has been used by other Sellers (internal dropshipper)

17. Seller understands and agrees that all Taxes related to Sales transactions (but not limited to changes in store information and/or goods), will be reported and managed by each Seller in accordance with the applicable tax provisions in the laws and regulations in Indonesia. .

18. Hobikoe has the authority to make decisions on unresolved transaction problems due to the absence of a settlement agreement, both between the Seller and the Buyer, by looking at the available evidence. Hobikoe's decision is a final decision that cannot be contested and binds the Seller and the Buyer to comply.

19. If agreed by the Seller and the Buyer, the use of Logistics services that are different from the buyer's initial choice can be made (provided that the shipping rate is below the initial shipping rate).

20. Hobikoe is authorized to deduct the excess shipping rate from the buyer's payment fund and return the excess shipping rate difference to the buyer.

21. The Seller fully understands and agrees that the invoice issued is in the name of the Seller.

V. Storefront Arrangement

1. Sellers are prohibited from using storefronts (including but not limited to store information and item information) as a medium to advertise or promote to other web pages outside the Hobikoe site.

2. Sellers are prohibited from providing personal contact data with the intention of conducting transactions directly to Buyers / potential Buyers.

3. The seller is prohibited from providing information (information on the store and/or goods) other than/outside the description of the store and/or the goods in question.

4. Naming of Goods and product information must be done in accordance with detailed information, specifications, and conditions of the Goods, thus Users are not allowed to include names, descriptions, pictures and/or words that are not related and/or do not match the Goods. The following is an example of how to create a product description, including the following:

• Pay attention to the use of sentences

• Explain product advantages

• Use sentences that will make the reader interested in buying

• Provide as complete information as possible

• Add sensory adjectives

5. Sellers who add video references to the Storefront window sourced from third party links including but not limited to Youtube and Google must comply with third party policies, in terms of Youtube policies can be seen HERE and Google Policies can be seen HERE.

6. Hobikoe provides a Video upload facility with a maximum duration of 15 seconds. This Video Upload can be used by Sellers to further introduce their selling products specifically, but Video uploaders (Sellers/Accounts) must meet the following requirements:

a. Do not upload videos that have nothing to do with the product to be sold

b. It is prohibited to upload videos that contain pornographic, violence, political, racial and racial intolerance, and/or those prohibited by the Republic of Indonesia Law, both the ITE Law, and/or the prevailing laws and regulations in Indonesia.

c. All activities, whether images, video content, are the full responsibility of the seller's or buyer's account, and Hobbykoe is released from any claims that occur in the future.

7. The naming of the goods and product information must be in accordance with the condition of the goods displayed and the user is not allowed to include names and information that are not in accordance with the condition of the goods.

8. Hobikoe has the right without prior notice to withdraw subsidies (discounts), cancel Rewards benefits, decrease content and/or store moderation, if violations are found as stipulated in Points V.4 and V.5.

9. The seller is obliged to separate each item that has a different size and price.

10. Hobikoe has the authority to take over the Seller's store sub-domain if the Seller's account has been inactive for more than 9 months, and/or the owner of the official trademark (in accordance with the General Register of Marks in Indonesia) with the same name as the Seller's sub-domain does claim against it because they want to use the sub-domain.

11. Hobikoe has the authority to change the name and/or use the name of the Store and/or User's domain for Hobikoe's internal interests.

VI. Commission

1. Hobikoe charges a 2% commission for transactions made through the Hobikoe Platform, and it will be different if the User uses certain features or services that are subject to service fees.

2. If in the future a commission system will be applied in transactions through the Hobikoe Platform, it will be notified to the affected Users through the Hobikoe Site.

VII. Price

1. The price of the Goods contained in the Hobikoe Platform is the price determined by the Seller. Sellers are prohibited from manipulating the price of goods in any way.

2. Sellers are prohibited from setting unreasonable prices on Goods offered through the Hobikoe Platform. Hobikoe has the right to take action in the form of moving the Goods to the warehouse, inspection, delay, or content reduction as well as other actions based on Hobikoe's own judgment on the basis of unfair pricing.

3. The Buyer understands and agrees that the error in price descriptions and other information caused by not updating the Hobikoe Platform page due to the browser/ISP used by the Buyer is the responsibility of the Buyer.

4. The seller understands and agrees that typographical errors that cause the price description or other information to be incorrect / appropriate are the responsibility of the seller. Keep in mind that in this case, if there is an accidental typing error in the price description of the Goods, the Seller has the right to refuse the order of the Goods made by the buyer.

5. The user understands and agrees that any problems and/or disputes that occur due to disagreements between the Seller and the Buyer regarding the price are not Hobikoe's responsibility.

6. By placing an order through Hobikoe, the User agrees to pay the total cost to be paid as stated on the payment page, which consists of the price of goods, shipping costs, and other costs that may arise and will be described explicitly on the payment page. The User agrees to make payment through the payment method previously selected by the User.

7. The maximum unit price limit for goods that can be offered is Rp. 300,000,000,-

8. The Hobikoe platform currently only serves goods buying and selling transactions in Rupiah currency.

VIII. Shipping Rates

1. The Buyer understands and understands that Hobikoe has made its best efforts in providing shipping rate information to Buyers based on location accurately, but Hobikoe cannot guarantee the accuracy of the data with those at the local branch.

2. Therefore Hobikoe advises the Seller to first record the rates provided by Hobikoe, so that they can be compared with the rates charged at the local branch. 3. The user understands and agrees that the difference in the cost of shipping the Goods is beyond Hobikoe's responsibility, and therefore, it is the Seller's own policy to cancel or continue to deliver the Goods.

IX. Return

1. Return of goods can only be returned if the goods do not match the description of the goods

2. Return of goods is the fault of the seller, and not the responsibility of Hobikoe

3. In returning goods, Hobikoe will supervise the return of goods, and ask the buyer to provide clear photos of the goods. If the buyer does not complete the requested details within the specified time, the payment will be forwarded to the seller

X. Content

1. In using any Hobikoe features and/or services, Users are prohibited from uploading or using words, comments, pictures, videos or any content that contains elements of SARA, discrimination, demeaning or cornering others, vulgar, threatening, advertising or do promotions to sites other than the Hobikoe Site, or other things that can be considered not in accordance with social values ​​and norms or based on policies determined by Hobikoe themselves. Hobikoe has the right to take necessary actions for violations of these provisions, including content deletion, store moderation, account blocking, and others.

2. Users are prohibited from using photos/images of goods that have a watermark indicating the ownership rights of others.

3. The User hereby understands and agrees that the misuse of the photos/images uploaded by the User is the User's personal responsibility.

4. Sellers are not allowed to use photos/images of goods or shop logos as a medium to advertise or promote to other sites outside the Hobikoe Platform, or provide personal contact data to make transactions directly to buyers/potential buyers.

5. The seller guarantees that the uploaded photos/images do not include content that is prohibited under Point X.1 or violates the property rights of other parties. If it is found that photos/images violate the content based on Point X.1 or there are reports of violations of the rights of other parties, Hobikoe has the right to take necessary actions for violations of these provisions, including but not limited to deleting content and/or other actions that need to be taken.

6. When a User uploads to the Hobikoe Platform with content or posts content, the User grants Hobikoe a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensed (through multiple tiers) right to exercise any and all copyright, publicity, trademark, database rights and intellectual property rights that the User has in the content, in any known media now or in the future. Furthermore, to the fullest extent permitted by applicable law, you waive your moral rights and undertake not to assert those rights against Hobikoe.

7. Users guarantee that they do not violate intellectual property rights in uploading User content to the Hobikoe site. Each User hereby is personally responsible for infringement of intellectual property rights in uploading content on the Hobikoe Platform.

8. Hobikoe provides a "Conversation" feature to make it easier for buyers to interact with sellers regarding the goods offered. The seller is not allowed to use these features for the purpose of increasing the price of his merchandise in any way, including making comments for the first time or making subsequent / continuous comments on a regular basis (flooding / spam).

9. Although we try to offer reliable information, we cannot promise that the catalog will always be accurate and up-to-date, and the User agrees that the User will not hold Hobikoe responsible for any discrepancies in the catalog. The catalog may include copyright, trademark or other proprietary rights.

10. Sales of products containing tobacco and/or e-cigarettes are only allowed to be sold into 1 (one) category, namely: Lifestyle Product Category in the Tobacco sub-category and Vapors/matches/Pipe sub-category

11. Hobikoe reserves the right at any time without prior notice, to take action to reduce content selling e-cigarette products, e-cigarette kits, e-cigarette liquids, and/or products containing tobacco on the Android platform, including but not limited to tobacco cigarette products. , nicotine, liquid vape, mod, pod, heatstick, vaporizer and/or E-Cigarette, subject to Google Play Store policy.

12. Hobikoe has the right at any time without prior notice, to take action in the form of decreasing the reputation of the store or moderating the store, if the Seller is suspected of manipulating content as regulated in point X.14, including but not limited to manipulation of writing product names, product images, descriptions products and/or other activities aimed at tricking the sale of content as regulated in point X.14 in order to continue to make offers using the Android Application.

XI. Types of Goods and Services

The following is a list of the types of Goods and Services that are prohibited and/or restricted to be traded by the Seller on the Hobikoe Platform:

All types of drugs or other substances which are prohibited or restricted in circulation according to the applicable legal provisions, including but not limited to the provisions of the Narcotics Law, Psychotropic Law, and Health Law. Also included in this provision are hard drugs, drugs that require a doctor's prescription, anesthetics and the like, or drugs that do not have a distribution permit from the Food and Drug Supervisory Agency (BPOM).

2. Cosmetics and food and drink that endanger the safety of their users, or do not have a distribution permit from the Food and Drug Supervisory Agency (BPOM).

3. Materials classified as Hazardous Materials according to the applicable Regulation of the Minister of Trade.

4. Certain types of Products that are required to have:

a. SNI;

b. Instructions for use in Indonesian; or

c. Labels in Indonesian.

5. While those being traded do not include these things.

6. Other goods whose ownership or circulation violates the legal provisions in force in Indonesia.

7. Goods that are the result of Copyright infringement, including but not limited to media in the form of books, CD/DVD/VCD, information and/or electronic documents, as well as other media that are contrary to the Copyright Law.

8. Adult goods of a sexual nature in the form of stimulant drugs, sex aids containing pornographic content, as well as strong drugs and adult drugs, both of which do not have a BPOM distribution permit or whose circulation is limited by applicable legal provisions.

9. Alcoholic drinks.

10. Advertising.

11. Any form of writing that can negatively affect the use of this site.

12. Used underwear.

21. Goods resulting from theft.

26. Cash includes foreign currency unless the Seller has and can include a license as a Non-Bank Foreign Exchange Business Operator based on Bank Indonesia Regulation No.18/20/PBI/2016 and/or other regulations related to foreign exchange.

28. Signal scrambler, signal remover, and/or other tools that can interfere with the signal or telecommunications network
