5. Seller, namely you, a person or legal entity who carries out activities, including but not limited to, being registered as a seller in the marketplace system of the Hobikoe.com Platform, conducting sales transactions on the Online Marketplace Hobikoe.com Platform, and agreeing to the Seller's Terms and Conditions at the time register as a Seller on the Hobikoe.com Online Marketplace Platform.
6. 7. 2. Content that is or is available on the Hobikoe.com Service or the Hobikoe.com Platform by the Hobikoe.com Platform. Users and Sellers are the responsibility of the Content uploader. And you hereby declare that you release hobikoe.com from claims for publishing such Content to the Hobikoe.com Service
TERMS OF USER REGISTRATION PLATFORM Hobikoe.com

d. You represent that the agreement with Hobikoe.com does not violate the terms, agreements, other rights and obligations with a third party.
e. You represent that all information and/or documents that you fill out or submit to hobikoe.com are accurate, true, complete, current and appropriate.
f. We have the right at any time to check the truth, validity of information or documents submitted to Hobikoe.com or to the Hobikoe.com Platform. If fraud or discrepancy is found based on an independent assessment, Hobikoe.com reserves the right to terminate, cancel or block your access and membership to Hobikoe.com services.

ELECTRONIC CONTRACT TERMS
The Electronic Contract is a form of engagement with your agreement to use the Hobikoe.com Services, including but not limited to the "General Seller Terms and Conditions" and "Hobikoe.com Online Marketplace Platform User Terms and Conditions". USER ACCOUNT TERMS
In using the Hobikoe.com Service, you are responsible for maintaining the confidentiality of all account content and passwords. If you are under 18 years of age, you are required to obtain parental or guardian consent, acceptance or approval from parents/guardians for these Terms and Conditions including consent to be responsible for: (i) Actions; (ii) all costs incurred in connection with accessing the Hobikoe.com Services or purchasing Products; and (iii) acceptance of and compliance with these Terms and Conditions.
TERMS OF COLLECTION AND COLLECTION OF USER PERSONAL DATA

2. Data recorded when the User uses the Site, including but not limited to:

b. data in the form of time from each User activity in connection with the use of the Site, including registration, login and transaction times;
c. User preferences or usage data, including User interactions in using the Site, saved choices, and selected settings. The data is obtained using cookies, pixel tags and similar technologies that create and maintain a unique identifier;
d. device data, including the type of device used to access the Site, including hardware model, operating system and version, software, IMEI number, file name and version, language choice, unique device identifier, advertising identifier, serial number, device movement information, and/or cellular network information; and/or

c. data from financial service providers, including but not limited to credit rating agencies or bureaus or the Credit Information Management Agency (LPIP);
d. data from financial service providers (if the User uses specific features such as applying for a loan through the Hobikoe Site/Application); and/or
e. data in the form of emails from marketing service providers.
Hobikoe can combine data obtained from these sources with other data in its possession.

TERMS OF USE OF PERSONAL DATA
Hobikoe may use Personal Data obtained and collected from Users as mentioned in the previous section for the following matters:
1. Process all forms of requests, activities or transactions made by Users through the Site, including for the purpose of sending products to Users.
2. Provision of features to deliver, deliver, maintain and improve our products and services, including:

d. contacting the User via email, letter, telephone, fax, and other communication methods, including but not limited to assisting and/or completing the transaction process or problem solving process, as well as delivering news or other notifications regarding the protection of User's Personal Data by Hobikoe, including failure of protection of User's Personal Data;
e. use information obtained from Users for the purpose of research, analysis, product development and testing in order to improve the security of services on the Site, as well as develop new features and products; and
f. inform Users regarding products, services, promotions, studies, surveys, news, latest developments, events and other information, either through the Site or through other media. Hobikoe may also use this information to promote and process contests and sweepstakes, award prizes, and serve relevant advertisements and content about Hobikoe services and their sellers.
4. Monitor or investigate suspicious transactions or transactions that are indicated to contain elements of fraud or violations of the Terms and Conditions or applicable legal provisions, as well as take necessary actions as a follow-up to the results of monitoring or investigating the transaction.
5. In certain circumstances, Hobikoe may need to use or disclose User's Personal Data for law enforcement purposes or to fulfill the requirements and obligations of applicable laws and regulations, including in the event of a dispute or legal process between the User and Hobikoe, or an alleged criminal act. such as fraud or data theft.

USER GENERATED CONTENT TERMS
1. 1. 1. Users are prohibited from using photos/images of goods that have a watermark indicating the ownership rights of others.
2. The User hereby understands and agrees that the misuse of the photos/images uploaded by the User is the User's personal responsibility.
3. Sellers are not allowed to use photos/images of goods or shop logos as a medium to advertise or promote to other sites outside the Hobikoe Site, or provide personal contact data to make transactions directly to buyers/potential buyers.
4. The seller guarantees that the uploaded photos/images do not include content that is prohibited or violates the property rights of other parties. If it is found that photos/images violate the content or there are reports of violations of the rights of other parties, then Hobikoe has the right to take necessary actions for violations of these provisions, including but not limited to deleting content and/or other actions that need to be taken.
5. When a User uploads to the Hobikoe Site with content or posts content, the User grants Hobikoe a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensed (through multiple tiers) right to exercise any and all copyright, publicity, trademark, database rights and intellectual property rights that the User has in the content, in any known media now or in the future. Furthermore, to the fullest extent permitted by applicable law, you waive your moral rights and undertake not to assert those rights against Hobikoe.
6. Users guarantee that they do not violate intellectual property rights in uploading User content to the Hobikoe site. Each User hereby is personally responsible for infringement of intellectual property rights in uploading content on the Hobikoe Site.
7. Hobikoe provides a "Conversation" feature to make it easier for buyers to interact with sellers, regarding the goods offered. The seller is not allowed to use these features for the purpose of increasing the price of his merchandise in any way, including making comments for the first time or making subsequent / continuous comments on a regular basis (flooding / spam).
8. Although we try to offer reliable information, we cannot promise that the catalog will always be accurate and up-to-date, and the User agrees that the User will not hold Hobikoe responsible for any discrepancies in the catalog. The catalog may include copyright, trademark or other proprietary rights.
9. Content or material that will be displayed or displayed on the Hobikoe Site/Application through the Feed will be subject to the Site Terms, legal regulations, and applicable advertising ethics.
10. KOL, Users or other parties who use the Feed feature are fully responsible for the content or material uploaded through the Feed feature.
11. Hobikoe has the right to at any time take down the content or material contained in the Feed which is considered to violate the Site Terms and Conditions, applicable legal regulations, and applicable advertising ethics.
12. Hobikoe reserves the right at any time without prior notice, to take action to reduce content if the contents of User Generated Content refer to Google Play Store policies which can be viewed HERE.
13. Hobikoe reserves the right at any time without prior notice, to take action in the form of decreasing the reputation of the store or moderating the store, if the Seller is suspected of manipulating content, including but not limited to manipulation of writing product names, product images, product descriptions and/or other activities that aims to trick content sales so that they can still make offers using the Hobikoe Application.

STORE INFO TERMS AND STORE STORE
1. Sellers are prohibited from using storefronts (including but not limited to store information and item information) as a medium to advertise or promote to other web pages outside the Hobikoe site.
2. Sellers are prohibited from providing personal contact data with the intention of conducting transactions directly to Buyers / potential Buyers.
3. The seller is prohibited from providing information (information on the store and/or goods) other than/outside the description of the store and/or the goods in question.
4. Naming of Goods and product information must be done in accordance with detailed information, specifications, and conditions of the Goods, thus Users are not allowed to include names, descriptions, pictures and/or words that are not related and/or do not match the Goods.
5. Sellers who add video references to the Storefront window sourced from third party links including but not limited to Youtube and Google must comply with third party policies, in terms of Youtube policies can be seen HERE and Google Policies can be seen HERE.
6. The naming of the goods and product information must be in accordance with the condition of the goods displayed and the user is not allowed to include names and information that are not in accordance with the condition of the goods.
7. Hobikoe has the right without prior notice to withdraw subsidies (cashback), cancel Rewards benefits, decrease content and/or store moderation, if violations are found.
8. The seller is obliged to separate each item that has a different size and price.
9. Hobikoe has the authority to take over the Seller's shop sub-domain if the Seller's account has been inactive for more than 9 months, and/or the owner of the official trademark (in accordance with the General Register of Marks in Indonesia) with the same name as the Seller's sub-domain does claim against it because they want to use the sub-domain.
10. Hobikoe has the authority to change the name and/or use the name of the Store and/or User's domain for Hobikoe's internal interests.

HOBIKOE BUYER POLICY TERMS:

PURCHASE
• Purchases must be made on the official Hobikoe website or application.
• Purchases must use the payment method that has been determined by Hobikoe.
• All buyers understand that all products on the Hobikoe website are sold and shipped by registered stores, not by Hobikoe.
Each buyer at the time of making a transaction agrees that:
• Each buyer has read and understood all product information such as description, price, weight, and other information and is responsible for the decision chosen by the buyer.
• Every buyer understands that the colors listed on the website may be different from the actual colors of the products sold, it depends on the monitor resolution of the device used by the buyer.
• Errors at the time of purchase such as inputting shipping address errors, nominal transfer errors and other errors are the responsibility of the buyer.
• Hobikoe does not transfer legal ownership of goods from the Store to the buyer.
• After the buyer checks out and for 1 (one) day the store does not confirm the order, the purchase is canceled and the transaction funds are returned according to the terms and conditions.
• Each buyer understands and agrees that the availability of product stock is the responsibility of the store that sells the product.
• If the purchase is canceled by the shop, system or Hobikoe admin then all transaction funds will be returned to the buyer according to the terms and conditions.
• Buyers cannot cancel purchases after the transaction process.
Consignee
• It should be understood beforehand that the one who sent the goods was not from Hobikoe.
• Goods that have been received and there are no complaints, the buyer must immediately confirm the receipt of goods.
• If the buyer does not confirm receipt of the goods after exceeding the time limit of 3 (three) days and the goods have been declared delivered based on information from the delivery service, the purchase process is declared complete and the transaction funds will be forwarded to the store transaction history.
Some things that allow goods to arrive late to the buyer:
• Hobikoe is not responsible for the delay in receiving the goods by the buyer.
• Delivery of goods is the responsibility of the store and the delivery service chosen by the store.
• Error shipping address, this is the responsibility of the buyer, shop or delivery service depending on the error that entered the address.
• Items lost during delivery, this is the responsibility of the delivery service.
• The goods are still in transit by the delivery service, because the estimated time is not correct, this is the responsibility of the delivery service.
• If the delivery service is late, it can be checked from the receipt number given by the store.
• Goods have arrived but are not directly received by the buyer concerned.
• If the status of the transaction is sent but the goods have not been received by the buyer, then make sure the goods have been received by other parties around such as other family members or closest neighbors.

COMPLAIN
• All errors during the transaction process, whether intentional or unintentional, are beyond Hobikoe's responsibility.
• Hobikoe only acts as a facilitator for complaints between buyers and shops.
• A valid complaint is a complaint made when the goods are received and the buyer confirms the receipt of the goods because the goods are not suitable.
• Complaints about the purchased product if there is a discrepancy, it is the responsibility of the buyer and the store.
• All costs for complaints that occur are the responsibility and agreement between the buyer and the shop.
• Transaction funds will be held in Hobikoe until the problem is resolved between the Buyer and the Store.
• If within 40 (forty) Days there is no agreement between the Buyer and the Store, then Hobikoe has the right to decide unilaterally the solution.

UNAUTHORIZED TRANSACTION
Unauthorized transactions are transactions that violate the Hobikoe terms and conditions. Transaction is invalid if:
• Buyers make fictitious or fake transactions in any way and purpose. (For example, transactions to increase shop ratings).
• Transactions made by hacking Hobikoe's account.
• Transactions carried out with indications of fraud such as the similarity of data between the Buyer and the Store, and so on.
• If an unauthorized transaction occurs, the Hobikoe account will be deactivated.
• All transaction funds will be returned (Refund) to the buyer according to the terms and conditions stated in the Return Policy
• If there is an invalid transaction more than once, the Hobikoe account will be permanently deactivated.
• If an unauthorized transaction occurs and leads to a violation of criminal or civil law, it will be processed according to applicable law.

 HOBIKOE SELLER TERMS

Don't forget to provide accurate product information by including a detailed product description. Complete information helps shoppers to shop safely. Serving buyers wholeheartedly can give your shop a chance to get a good rating and get good feedback from buyers.
2. Be a polite seller
We want to maintain a safe environment for everyone to enjoy a pleasant online shopping experience. Make sure your content remains appropriate and in accordance with the norms. This means that it does not contain vulgar language or words, offending SARA sentiments, harsh words, spam and others. We require mutual respect and good behavior. Ensure transactions are safe and enjoyable for everyone.
3. Take care of your store's reputation
Create a pleasant shopping experience for your shoppers by replying to their messages quickly and precisely. Shoppers with high levels of satisfaction are more likely to shop again and give your store a good rating.

PROHIBITED THINGS
1. Violating the General Terms of Hobikoe Products
Products sold on Hobikoe must display clear and understandable information. We will also limit the types of products that can be traded according to Hobikoe's policies.
2. Product name and details are irrelevant
We want all Hobikoe users to get relevant information when opening a product page. Make sure that your Photo, Name and Product Description are appropriate and really display the product you want to sell. Each product page can only be used to sell one type of object and one brand, unless the product being sold is indeed a product that is sold in packages (bundling).
3. Product photos that contain negative elements
Hobikoe is an online marketplace platform that can be accessed by anyone and we want to keep all users comfortable. You are prohibited from uploading photos containing vulgar and abusive language or words, offending SARA sentiments, and others.
4. Spam words
Hobikoe prohibits the use of spam words so that users can find products easily. Spam words are words that are irrelevant or not related to the product being sold. Adding irrelevant brand names, keywords or hashtags will hinder the product search process, and may cause the product to be removed or blocked by our system. Examples of prohibited spam words:
a. Using irrelevant keywords in the product name. Example: Selling kris, precious stones etc. Always make sure the product name contains only one type of item that matches the product.
b. Include other items in the product description other than the product being sold. Example: selling stones, but in the description of other products/services
c. Listing irrelevant numbers or letters in the product name. Example: Majapahit coin 12356 or QWERTYYIOPOPAS gemstone.
d. Include redundant word repetition in product names. Example: discount discount antiques.
e. Listing incorrect or inappropriate brand attributes. Example: If the product you are selling is Antique Painting, make sure the attributes are listed correctly, not other irrelevant products.
5. Uploading (uploading) duplicate products
A product is said to be a duplicate if the product is uploaded (uploaded) many times without any significant difference between them. Sellers are prohibited from uploading (uploading) duplicate products from any account, including if users create different accounts to sell the same product and sell with duplicate accounts. This may cause your product to be automatically blocked by our system.
6. Using old product pages to upload new products
Product pages that already have ratings are strictly prohibited from being used to sell a different product. If Hobikoe detects this, your product will be restricted. You can return the product page details to the original product no later than 3 (three) days or the product will be deleted.
7. Price manipulation
Manipulating prices is a violation of Hobikoe rules for example: listing a product at a very low price for the purpose of not being sold or bought by Hobikoe users. This may cause your product to be automatically blocked by our system.
8. Directing Buyers for transactions outside of Hobikoe
It is strictly forbidden to direct Buyers to make transactions outside of Hobikoe, such as by including your name, logo and other buying and selling place links in your product/store name/description. This may result in your product being removed or blocked by our system. You are also prohibited from including personal contacts such as mobile phone numbers, SMS or WhatsApp. The social media platforms listed on Hobikoe only serve as a means of conveying information about sellers in order to gain more trust from buyers to make transactions at your store.
9. Identity fraud
Fraud and identity fraud are serious offenses in Hobikoe. Respect the rights of others and write clearly If you use other people's photos (not actual photos).
 The following are examples of identity fraud:
a. Collect and use other people's data without their knowledge (such as personal data, photos, and other personal data).
b. Misuse someone else's identity to increase the credibility of your account.

10. Product non-conformance
If there is a discrepancy between the title, description, pictures, and promises of the products and services, it is the responsibility of the seller. Hobikoe is not responsible for the conditions conveyed by the seller.
11. Unauthorized use of the Hobikoe logo
Any use of the Lowest Price Guarantee logo/watermark and/or other Hobikoe-related logos for promotional and/or other marketing purposes must obtain official permission from Hobikoe. Hobikoe reserves the right to delete and/or adjust content, including limiting user accounts if necessary, for any use of the Lowest Price Guarantee logo/watermark and/or other Hobikoe-related logos that are detected to be unlicensed.
12. Violation of the terms of service and fraud
All promo codes are provided to Sellers to help increase and grow user sales. The following are strictly prohibited on our platform:
a. Sales information fraud
b. Misuse of product discounts and Free Shipping
c. Voucher Abuse
d. Fraud in any form
13. Interfering with other users' selling activities
Hobikoe has the right to freeze the account and/or cancel the transaction and/or give penalty points if the user is found to have taken actions that interfere with the selling activities of other users.
Hobikoe monitors all user accounts and ensures that users comply with all our regulations. Violation of this rule may result in but not limited to the following actions:
a. Permanent deletion of user accounts
b. Freezing of Hobikoe Guarantee funds for investigation if needed
c. Civil and/or criminal lawsuits or provision of material and immaterial compensation

PATENT PROVISIONS

TERMS FOR RETURN OF GOODS/FUND
Subject to the terms and conditions in this Refund Policy and Goods and Terms of Service, Buyer may apply for the return of the purchased goods (“Items”) and/or refund prior to the expiration of the Hobikoe Guarantee Period.
Hobikoe Guarantee is a service provided by Hobikoe, at the request of the User, to assist the User in dealing with certain conflicts that may arise during the course of the transaction. Users can communicate with each other privately to resolve their conflicts or differences of opinion or contact local authorities to help them resolve disputes that occur before, during or after using the Hobikoe Guarantee.
1. Application for Return of Goods and/or Refund
Buyers may only apply for Return of Goods and/or refund in the following situations:
Goods are not received by the Buyer (up to the specified/promised limit)
the item is defective and/or damaged upon receipt;
The Seller has delivered the Goods that do not match the agreed specifications (eg wrong size, color, etc.) to the Buyer;
Goods delivered to Buyer are materially different from the description provided by Seller in the list of Goods; or
Through a personal agreement with the Seller and the Seller must send confirmation to Hobikoe regarding the agreement.
Buyer's Application must be submitted via link.
Hobikoe akan meninjau setiap permohonan Pembeli kasus per kasus dan, atas kebijakannya sendiri, menentukan apakah permohonan Pembeli berhasil atau tidak.
Jika Pembeli telah memulai tindakan hukum terhadap Penjual, Pembeli dapat memberikan pemberitahuan formal dari pihak yang berwenang kepada Hobikoe untuk meminta Hobikoe terus menahan uang pembelian sampai penetapan resmi tersedia. Atas kebijakannya sendiri yang mutlak, Hobikoe akan menetapkan apakah perlu untuk terus menahan uang pembelian tersebut.
2. Tidak Ada Perubahan Pikiran
Kecuali dinyatakan dalam Kebijakan Pengembalian Dana dan Barang ini, Pembeli tidak boleh mengajukan permohonan pengembalian Barang dan/atau dana melalui Garansi Hobikoe apabila berubah pikiran.
3. Hak Penjual
Ketika Hobikoe menerima permohonan dari Pembeli untuk pengembalian Barang dan/atau pengembalian dana, Hobikoe akan memberi tahu Penjual secara tertulis. Penjual dapat menanggapi permohonan Pembeli sesuai dengan langkah-langkah yang diberikan Hobikoe dalam pemberitahuan tertulis. Penjual harus menanggapi dalam jangka waktu yang ditetapkan dalam pemberitahuan tertulis (“Jangka Waktu yang Ditetapkan”). Apabila Hobikoe tidak mendapatkan tanggapan dari Penjual dalam Jangka Waktu yang Ditetapkan, Hobikoe akan menganggap Penjual tidak memiliki tanggapan atas permohonan Pembeli dan akan melanjutkan untuk menilai permohonan Pembeli tanpa pemberitahuan lebih lanjut kepada Penjual.
Hobikoe akan meninjau setiap tanggapan Penjual secara kasus per kasus dan, atas kebijakannya sendiri, menentukan apakah permohonan Pembeli melawan situasi yang dikemukakan oleh Penjual tersebut berhasil atau tidak.
4. Syarat Mengembalikan Barang
Agar tidak terjadi hal yang merepotkan saat mengembalikan barang, Pembeli harus memastikan bahwa barang, termasuk setiap barang gratis/bawaan seperti aksesoris yang datang bersama dengan barang, harus dikembalikan kepada Penjual dalam kondisi yang diterima oleh Pembeli pada saat pengiriman. Kami akan menyarankan Pembeli untuk mengambil foto dan video barang pada saat diterima.
5. Tanggung Jawab Biaya Pengiriman Barang Yang Dikembalikan
Dalam perihal kesalahan yang tidak terduga dari sisi Penjual (yaitu produk rusak, cacat atau salah dikirimkan ke Pembeli), Penjual atau Pembeli akan menanggung biaya pengiriman pengembalian Barang bergantung pada kesepakatan Penjual dan Pembeli
Dalam perihal di mana Penjual dan Pembeli mempersengketakan siapa pihak yang bertanggung jawab atas biaya pengiriman Barang yang dikembalikan, Hobikoe atas kebijakannya sendiri akan menentukan siapa pihak yang akan bertanggung jawab atas biaya pengiriman pengembalian Barang.
